The 9th paragraph of the Cabinet of Ministers (CM) of the Republic of Latvia (LR) regulations regarding distance contracts states that the Consumer* has the right to break a contract within 14 calendar days and return an item to the seller. However, paragraph 14.1 of the LR CM May 28, 2002 regulation no. 207, “Regulations Regarding Distance Contracts,” determines that, “If a consumer exercises the right of withdrawal as stated in these regulations, he is responsible for the reduction of value of the item in any way if the item has been used in bad faith, including for purposes other than for determining the characteristics or use of the item.”
Due to this legislation, Chameleon Sounds, Ltd. retains the right to bring a civil suit to court against a consumer to receive restitution for losses incurred by Chameleon Sounds, Ltd. including instances when an item is not returned in its original packaging, the packaging is considerably damaged, or the item has been noticeably worn, scratched, etc. In cases where the original packaging must be broken to use the item (for example, the plastic covering on a CD or DVD), the damaged packaging will not be the basis for starting a civil suit against the Consumer. In this circumstance, we ask the Consumer to return the packaging along with the purchased item. To most quickly process returns, we ask that if possible, these types of items be opened carefully.
*- henceforth, according to section 1, paragraph 3 of the Consumer Rights Protection Law, the Consumer is, “a natural person who expresses a wish to purchase, purchases or might purchase, or use goods or a service for a purpose, which is not related to his or her economic or professional activity.”
